Infringement and Remedies to Utility Model Right
Under the Korean Utility Model Act, the content/method of protection of a utility model right is almost identical with that of a patent right. Thus, with regard to this matter, please refer to the Infringement and Remedies to Patent Right. However, in the case of a utility model which was registered without a substantive examination by an examiner under the revised Korean Utility Model Act (effective from July 1, 1999), the owner can execute the utility model right only when an examiner renders a decision to maintain the utility model registration as a result of substantive examination of basic requirements which is made upon request after the registration (referred to as "Technical Evaluation" in distinction from the examination before the registration in the Patent Act) |
