5. Demand of The Permit of a Customs Clearance

The importer/exporter who wishes to demand allowing a customs clearance on goods involved should submit an application containing the following along with the evidential materials verifying that he has not infringed the trademark right or copyright:

- the number of the report;
- the name of importer/exporter;
- reasons for the above demand; and
- details verifying that the infringement is not made.

The demander should offer the amount covering the amount in Paragraph 4-4) which would be offered by the other party plus 25% of the same price as security to the customs director along with an affidavit to the effect that the security offered may be used to compensate for the possible damages to the importer/exporter due to the above request in compliance with the court's judgement.

Upon receipt of the above demand, the customs director promptly should notify the Commissioner of Customs and the other party of the same fact and decide on the permit of a customs clearance on goods involved within fifteen (15) days from the demand.
