IPR's Protection in Customs Law

1. Purpose

Intellectual property rights in Korea are generally protected under each of the related laws. Especially, when it comes to goods or works related to a trademark right or copyright, their international circulation has been steadily increasing, thanks to the growing demand by consumers and the lowering of prices. In coping with this trend of globalization in the market and the growing importance in the prohibition of exports and imports of goods or works which infringe trademark rights or copyrights on a national basis, the IPR-related provisions were established in the Customs Law within the same law's revision of December 1993. Further, Regulations on Importation/Exportation of Customs Clearance were provided under the law, and they have been revised five times since their enactment of January 1994 in order to enforce the protection of trademark rights or copyrights complying with the international standards. The main points of the current regulations are as follows:
