EU's Trademark/Design Protection Expands to 25 Nations
With expansion of EU members to 25 following the entry of 10 more central and east European countries, the area for protection of EU trademarks and designs also expanded to all 25 EU member nations.
Consequently, there is no need for Korean enterprises that have their trademarks or designs already registered with the OHIM to file separate applications with the newly joined EU member countries. When filing international trademark applications, designation of these nations is not necessary either, in accordance with the Madrid Protocol that went into effect on April 10 last year.
Due to the expansion of EU members, however, any trademark application filed after May 1, 2004, can not be registered as an EU trademark if it had been registered in advance by one of the 25 EU members or it already exists as a domestic trademark in any of the EU member countries.
